MINUTES OF SIOUX COUNTY BOARD OF SUPERVISORS MEETING HELD ON JANUARY 2, 2019 1) The Board of Supervisors of Sioux County, Iowa, met pursuant to adjournment at 9:00 a.m. with Ryan Dokter, County Auditor presiding as Temporary Chairman until a new Chairman was appointed. Members present were John Degen, Jerry Muilenburg, Carl Vande Weerd, Mark Sybesma, and Al Bloemendaal. 2) Oaths of office were administered in the second floor courtroom by County Auditor Ryan Dokter to Sioux County Attorney Thomas Kunstle, Sioux County Treasurer Randy Jacobsma, Sioux County Recorder Jessica Kooiker, and Sioux County Supervisors Jerry Muilenburg and Carl Vande Weerd. The meeting then moved to the Board of Supervisors room. 3) Motion by Bloemendaal and supported by Vande Weerd to appoint Mark Sybesma, County Supervisor as Chairman of the Board of Supervisors for calendar year 2019. Motion carried unanimously. Chairman Sybesma presided over the remainder of the meeting. 4) Motion by Bloemendaal and supported by Muilenburg to appoint John Degen, as ViceChairman of the Board of Supervisors for calendar year 2019. Motion carried unanimously. 5) Minutes of the meeting held on December 18, 2018, were submitted, and the Chairman declared them approved. 6) Motion by Degen and supported by Muilenburg to appoint Doug Julius as the County Engineer, County Weed Commissioner, and Sanitarian. Motion carried unanimously. 7) Motion by Bloemendaal and supported by Vande Weerd to appoint Shane Walter as the County Zoning Administrator, Community Services Director, Veterans Affairs Director and Environmental Health Administrator. Motion carried unanimously. 8) Motion by Vande Weerd and supported by Degen to appoint Aaron Haverdink as the Regional Service Coordinator (Sioux Rivers), and General Services Director for General Assistance Program. Motion carried unanimously. 9) Motion by Muilenburg and supported by Vande Weerd to appoint Dr. Jonathan Grossmann as County Medical Examiner. Motion carried unanimously. 10) Motion by Vande Weerd and supported by Bloemendaal to appoint Dr. Bradley Kamstra as County Deputy Medical Examiner. Motion carried unanimously. 11) Motion by Bloemendaal and supported by Degen to appoint Lee Kamstra and Barb Top to the County Board of Health. Motion carried unanimously. 12) Motion by Bloemendaal and supported by Vande Weerd to appoint Carl Moss and Ron Smit to the Planning and Zoning Commission and to appoint Minde Schuiteman to fill a vacancy on the Planning and Zoning Commission. Motion carried unanimously. 13) Motion by Muilenburg and supported by Degen to appoint Donald Boersma to the Board of Adjustment. Motion carried unanimously.
14) Motion by Degen and supported by Bloemendaal to appoint Jerry Jensen to the County Conservation Board. Motion carried unanimously. 15) Motion by Degen and supported by Muilenburg to appoint Rob Klocke to the Loess Hills Development and Conservation Authority. 19) Ryan Dokter, County Auditor, reported that the following four newspapers have filed written applications to become one of the three official county newspapers for calendar year 2019 and that a contest exists for the selection of said official newspapers: • Sioux County Capital-Democrat
• Sioux Center News • Siouxland Press • Index Reporter. Motion by Degen and supported by Bloemdendaal to declare that a contest does exist for the selection of the three official county newspapers for 2019; and to instruct Ryan Dokter, County Auditor to notify the four official county newspaper applicants that they are to deposit with the County Auditor, in a sealed envelope, a statement, verified by the applicant, showing the names of the applicant’s bona fide yearly subscribers living within the county and the place at which each such subscriber receives such newspaper, and the manner of its delivery. The Board will determine the bona fide yearly subscribers of each official county newspaper applicant at 9:00 o’clock a.m. on January 8, 2019. WHEREAS, Iowa Code section 459.304(3) sets out the procedure if a board of supervisors wishes to adopt a “construction evaluation resolution” relating to the construction of a confinement feeding operation structure; and WHEREAS, only counties that have adopted a construction evaluation resolution can submit to the Department of Natural Resources (DNR) an adopted recommendation to approve or disapprove a construction permit application regarding a proposed confinement feeding operation structure; and WHEREAS, only counties that have adopted a construction evaluation resolution and submitted an adopted recommendation may contest the DNR’s decision regarding a specific application; and WHEREAS, by adopting a construction evaluation resolution the board of supervisors agrees to evaluate every construction permit application for a proposed confinement feeding operation structure received by the board of supervisors between February 1, 2019 and January 31, 2020 and submit an adopted recommendation regarding that application to the DNR; and WHEREAS, the board of supervisors must conduct an evaluation of every construction permit application using the master matrix created in Iowa Code section 459.305, but the board’s recommendation to the DNR may be based on the final score on the master matrix or may be based on reasons other than the final score on the master matrix; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF SIOUX COUNTY that the Board of Supervisors hereby adopts this construction evaluation resolution pursuant to Iowa Code section 459.304(3). /s/ Mark Sybesma Chair, Board of Supervisors Date: January 2, 2019 ATTEST: /s/ Ryan Dokter County Auditor Date: January 2, 2019

24) As the was the date and time, 9:45 a.m. for a Public Hearing on a proposed amendment to the County FY2019 budget. Chairman Sybesma opened the Public Hearing. Sioux County Auditor, Ryan Dokter, reported that an error was made on the budget amendment #2 done in December 2018. This amendment returns the non program service area amount to $540,000. No public comments or or written were received. The Chairman closed the Public Hearing. Motion by Degen and supported by Muilenburg to approve the budget amendment. WHEREAS, the Sioux County Board of Supervisors has considered the proposed FY 2018/2019 county budget amendment, and WHEREAS, a public hearing concerning the proposed county budget amendment #3 was held on January 2, 2019, NOW THEREFORE BE IT RESOLVED by the Board of Supervisors of Sioux County that the county budget amendment #3 for FY 2018/2019, as set forth in the budget summary, is hereby adopted and that the Sioux County Auditor is directed to file said budget and to establish accounting records in accordance with the attached schedules. 25) Thomas Kunstle, Sioux County Attorney, informed the Board that the Assistant County Attorney, Tyler Grevengoed is leaving Sioux County February 1, 2019 for employment in Council Bluffs. 26) Doug Julius, Sioux County Engineer • •
Updated the Board on secondary road activities. The costs for damages due to flooding has been submitted to FEMA for review and processing.
27) Dave Winterfeld did a presentation on a proposed Sioux County Expo Center. This facility would be used for many purposes including livestock shows, rodeos, and farm implement shows. This facility could accommodate the Sioux County Fair if the Fair Board chooses to use it. Winterfeld is working with investors and have raised approximately 5.5 million dollars of the 8.5 million dollars of estimated cost. Winterfeld requested a property tax abatement from the Board, for 10 years, with the first 3 years of zero taxation, and a graduated scale for the next 7 years. The Board took no action on this request and will bring this up for discussion at a future meeting. 28) Committee Reports: •

Sybesma – Reported on a meeting with the Rolling Hills Mental Health Region and Sioux Rivers Mental Health in regards to the Crisis Center in Sioux City. A preliminary agreement was put in place, in which Sioux Rivers maintains ownership and control of the Crisis Center, but Rolling Hills will pay 75% of the costs and Sioux Rivers will have 25% of the cost. The costs to Sioux Rivers could be offset further by Medicaid reimbursements. Shane Walter, Sioux Rivers CEO was present for this report. Bloemendaal – Reported on the Northwest Iowa Planning meeting from December 20. The Iowa DOT reported it has received many funding requests for trails, but there is not much funding available. The DOT also discussing the use of roundabouts at busy intersections to keep the flow of traffic moving.
